1) What is a Bail Bond?

When someone is arrested on motor vehicle or criminal charges, the person may be held in jail until trial unless they furnish the required bail. This may be done by posting a Bail Bond.

When a bond is issued, the bonding company or "surety" guarantees that the defendant will appear in court at a given time and place. If the defendant fails to appear, the bond amount becomes payable and is forfieted by the surety insurer issuing the bond.

2) Who issues Bail Bonds?

Bail Bonds are issued by a licensed "Bail Bond Agent" who acts as the appointed representative of the licensed surety insurance company. The Bail Bond Agent always requires a state set fee as well collateral, which is necessary depending on the amount of bail.

3) How much does a Bail Bond Agent charge?

Connecticut Law requires all Bail Bond Agencies in the state to charge 10% on $5000 or less and 7% on anything over $5000.

The court determines the amount of the bond. Once paid, the premium for a bail bond is not refundable.

3) What is the consumer agreeing to in a Bail Bond Contract?

The consumer is agreeing to:

A) Pay the premium for the bond at the rate agreed upon.
B) Provide collateral if needed.
C) Pay actual. Necessary and reasonable expenses incurred by the Bail Bond Agent in connection with the transaction. These may include:

  • Bail Enforcement Agent fees and expenses.
  • Payment of the total bond for the defendant's failure to appear.
  • Attorney fees and court costs.

D) Keep the Bail Agent or Company advised of the address/employment changes of the defendant or other parties to the agreement.
E) Aid the bail Agent in locating the defendant.
